as pg&e deals with the aftermath of the san bruno disaster and moves to fix a troubled natural gas infrastructure, will you have to pay for it? good afternoon. i'm claudine wong in for tori campbell. right now the public utilities commission is trying to decide if pg&e can raise its rates to pay for upgrades to its natural gas transmission system. a bay area lawmaker is calling

on the p.u.c. to reject that proposal. we're live with details on what jerry hill and advocates had to say. >> reporter: after the san bruno pipeline disaster the california public utilities commission ordered all utilities in the state to make upgrades to their pipeline systems, presume plea to prevent a disaster like the one that happened in september 2010 from ever happening again. to pay for that long term maintenance work, pg&e says it needs to spend $2.2 billion. the money for those upgrades would be passed on to rate payers over the next 45 years. members of turn the utility reform network and assemblyman jerry hill say that's not fair. they held a press conference outside the cpuc calling on the agency to reject pg&e's $2.2 billion proposal. hill says pg&e's shareholders should pick up the tab for this maintenance work, not the rate payers. >> the rate payers have already paid for the pipes that are underground. they've already paid for the system that we have once. because it was not properly

maintained, of it not properly taken care of, it was not properly tested in the manner that would be appropriate, that now we're expected to pick up and pg&e's request 95% of that cost. >> reporter: hill says after taxes, interest and profit, rate payers would end up paying $5 billion over the next 45 years. in response pg&e says it's charging its shareholders for some of the maintenance work they've been doing since 2010 through 2014. a you till spokeswoman says under their plan future upgrades will be paid for by rate payers. >> this ongoing maintenance work and really the work to make our system one of the leading systems in the nation will be covered by rate payers and that's again about a there are 2 increase. >> reporter: now it's all in the hands of the cpuc. the agency must either reject or approve pg&e's $2.2 billion spending plan. when they are going to reach a decision is not known. they don't have a strict or

firm deadline they have to meet by the time they make their decision. back to you. >> thank you. a firefighter dislocated his shoulder while fighting an overnight house fire in the oakland hills. flames were surge 15 to 20 feet in the air when firefighters arrived to the scene at michigan avenue and sunkist drive around 1:40 a.m. the fire was out by 2:30. they had to go back around 6:00 a.m. to put out hot spots. some trees and shrubs caught fire. >> we were able to contain the fire to the initial home. we put up a water curtain adjacent units to keep it from spreading. >> one firefighter dislocated his shoulder after the floor inside the burning home collapsed. he was taken to the hospital. investigators say no one was living in the home. crews made quick work of another fire in oakland this

morning it. broke out in an apartment building on the 9400 block of hillside street. firefighters were called to the scene about 8:30 a.m. and had that fire under control and out within ten minutes. no one was injured. a federal safety official is on his way to the chevron refinery in richmond. the chairman of the u.s. chemical safety board is expected at that site later today. it's not clear how close he will get to the fire site because the pipe that failed is still considered unstable. bay area air quality officials now say they were not able to gather significant data on the toxic smoke that spewed throughout the region. that's because the smoke shot up in the air and passed the air quality monitoring devices. a massive wildfire near redding has grown to 15,000 acres. cal fire released new numbers about 30 minutes ago. 300 homes are threatened in the

shasta and tahama counties. seven homes have been lost since fire started saturday. >> we'll get the trailer hooked up in case we got to get out of here, move a few cows, load some furniture up and get out. >> more than 1,000 firefighters are battling the fire. containment is only at 5%. lightning may have sparked that wildfire. we'll go to rosemary now. >> hot and dry about sums it up for that area today. temperatures in the 80s warming to the low 90s for the afternoon. humidity about 22% but dropping to 12%. on a positive note, the winds are generally light. that will change. we have a system approaching california. by tomorrow a fire weather watch is anticipated for the northeast corner of california where the ponderosa wildfire is

burning. the wind gusts could reach 35 miles per hour tomorrow. humidity expected to drop down into the single digits. that's a big concern for the firefighters. we will keep tracking that for you. the same system bringing that fire weather watch to that area will bring us a cooldown here at home. san jose police say they're having a tough time finding enough resources to respond to the recent spike in violent crime. we're live with more on the recent homicide and how the community is responding. >> reporter: this mid-town memorial for the woman murdered last monday here has been growing. you can see flowers, heartfelt notes. this is one of four san jose murders in the last week prompting one person to write what many are thinking. stop the violence. david garza is like many who drop by with kind words and candles near this tree at san

carlos and meridian where an elderly woman was murdered last monday. >> i felt guilty that i didn't know her name. >> week after week he'd ask her if she needed anything but she refused help. >> it makes me very sad. you can't even walk the streets and, i'm sorry, but that's somebody's sister, possibly mother. >> san jose police say jane doe was stabbed to death with a samurai sword. they arrested 37-year-old marquise reynolds. investigators are still looking for a suspect in two different shootings yesterday. man died from multiple gunshot wounds early morning on the 3,000 block of van sansel. sunday night another spix shot at another man on the 1600 block of east san antonio. the victim is hospitalized with life threatening injuries. >> i don't see the boys that look so much like they're gang

related. yeah, it's pretty scary. >> in a little more than a week four people have been killed bringing the homicide count to 28 so far this year. >> we got here as quickly as we could but we didn't have the kind of response we usually have because with fewer officers. >> reporter: there are signs around this neighborhood like this chalk drawing on the sidewalk asking people to come to a vigil tonight here for jane doe. that's at 7:30 p.m. tonight. they'll have a pastor, musicians and prayers. back to you. >> thank you. late this morning the contra costa county coroner released the identity of man hit and killed by an ambulance in antioch. it happened last night on highway 4 near eighth street. 62-year-old michael moore of brentwood got out of his car and was trying to run across the highway and that's when he

was hit by the ambulance. >> the ambulance driver stops and attempted to render first aid to the subject but he succumbed to his injuries. >> the eastbound lanes of the highway were closed for several hours while that accident was investigated. the legal fight between apple and samsung will wrap up this week. apple is suing samsung for patent infringements related to the iphone. it want morse than $2 billion in damages. samsung is arguing that apple infringed on its patent and should have to pay them. testimony wrapped up fry. the jury could start deliberating wednesday. apple's surging stock today now has the cupertino company listed as the most valuable company of all time. with a value of $623 billion. apple has been the world's most valuable company since the end of 2011. it's now worth 53% more than the number two company which is exxon mobil. when the going gets rougher, the tough get going. they're going to win it.

check out these pictures. a bus crashed into a home this morning in montgomery county, maryland, just outside washington, d.c. the accident happened just before 11:00 a.m. eastern time. no injuries were reported. it was a dramatic scene. the cause of that accident has not been released. one person was rescued from a car that collided with a peckup truck and light pole in san jose around 1:15 a.m. at the intersection of branham and ?rel. firefighters had to use heavy equipment to free a passenger in the car. no word on the victim's condition. today is do or die time for the petaluma nationals. the team playing in the little league world series. this is a live picture from the boulevard 14 cinemas in petaluma where the local fans have filed inside. they'll be watching their team in a must-win game today in pennsylvania. the nationals are scheduled to

enhancing drugs took a bizarre turn. an associate of his is accused of purchasing a website featuring nonexistent sports cream. it was an attempt to get cabrera for getting him of his 50-game suspension. >> he's looking at a big contract from somebody, maybe that's going to be deeply discounted now. so there's money on the line. >> i'm wondering if more people are going to do it in the future or not. >> this year major league baseball has suspended four players who tested positive for performance enhancing drugs and two of the players are from the giants. we stopped by the radio station in san francisco this morning where the hosts say many fans are over the controversy and looking forward to seeing what's ahead for the giants. >> a lot of them have moved on and they're looking forward to

them this morning using the cell phone of a farm ore jersey island. his family reported him missing last night. he says his wave runner ran out of gas. he had to swim ashore to jersey island and slept there overnight before finding that farmer. he is in good condition. a prominent bay area activist who played a major role in the black panther party was reportedly an f.b.i. inform ntd. that's according to the center for investigative reporting. they say the f.b.i. recruited richard aoki in the late 1950s just as he was about to graduate from berkeley high school. he is reportedly credited with giving guns to the black panthers and training them on how to use the weapons after joining the party in 1967. he committed suicide in 2009 after battling an illness. in san francisco, this is the day for new clothes, new backpacks and new teachers as children return to the classroom. it's the first day of school. we watched as students and parents arrived at everrette

middle school on church street. mayor ed lee was also on hand to help kick off the new school year. >> i'm kind of excited that it's a new school, but i'm nervous because i've never been to a middle school. >> i wanted to welcome the kids back and make sure they act like a sponge, just suck all of the knowledge they can in. >> schools superintendent also greeted arriving students. some students in the east bay will be starting the school year on a good note thanks to some sweet gifts from a bay area candy company. the american licorice company in union city is donating school supplies to about 1800 children. today volunteers gave out backpacks full of goodies to students at the achieve academy in oakland. next went day they'll distribute sup thriez kids at

manuel elementary school in union city. the message to school food workers this year is that there will be a lot more healthy foods on the menu but the trick is going to be getting the kids to eat them. that was the word this week in denver at the school nutrition association. with new agriculture department guidelines, expect more whole grains and fruits and vegetables. at the meeting workers heard tips on how to get school kids to go for the healthier foods. a piece of naval history was moved today. the crane hoisted a 30,000- pound anchor in the air. it placed it on a flatbed truck. that anchor is from the world war ii aircraft carrier the u.s.s. -- it's being moved to its sister ship the u.s.s. hornet which is dock ted museum in alameda. >> it's preserving a piece of world war ii history and the maritime naval history.

taking a look at your big board, the dow is down just about nine points. facebook stock not doing well, hit an all-time low of just over $18 this morning. there is a recall of 2,000 cases of lettuce in california and several other states because of signs of e. coli. random testing turned up signs of it. all the real estate point lettuce is from one grower in salinas. it's sold as field fresh wrapped single head romaine. it has a use by date of august 19. no reports of anyone getting sick from the lettuce. breaking news, comedian phyllis diller has died. her manager says she died this morning at her home in los angeles. phyllis diller was 95 years old. rayly's has announced plans to close two stores in northern
